1. About These Terms
These Terms of Service ("Terms") govern your access to and use of klariva.shop (the "Site") and any purchase you make through it.
The Site is operated by:

References to "we," "us," and "our" mean Jayen LLC. References to "you" mean the person accessing the Site or placing an order.
By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
We sell to customers in several countries. Sections 1 to 17 apply to everyone. Section 18 sets out additional or overriding provisions for specific countries. Where Section 18 conflicts with an earlier section, Section 18 prevails for customers in that country.
2. Eligibility
You must be at least 18 years old, or the age of majority in your place of residence, to place an order. By ordering, you confirm that you meet this requirement and that you are ordering for personal, non-commercial use unless we have agreed otherwise in writing.
We may refuse service, close accounts, or cancel orders at our discretion, including where we suspect fraud, resale, or breach of these Terms.
3. Products and Product Information
We take care to describe our products accurately. However:
- Product images are illustrative. Colours, packaging, and design may vary from what is shown on your screen.
- Product descriptions, specifications, and availability may change without notice.
- We do not warrant that descriptions, pricing, or other content on the Site is complete, current, or error-free.
No professional advice. Books, guides, and other informational products we sell are for general information only. They do not constitute medical, psychological, legal, financial, or educational advice, and they are not a substitute for consultation with a qualified professional.
Dietary supplements. Where we sell dietary supplements, those products are not intended to diagnose, treat, cure, or prevent any disease. Statements about such products have not been evaluated by the U.S. Food and Drug Administration or by any equivalent authority in your country. Consult a physician before use, particularly if you are pregnant, nursing, taking medication, or have a medical condition.
4. Orders and Formation of Contract
Your order is an offer to purchase. It is not accepted until we send you a dispatch confirmation. An order confirmation email acknowledges receipt only and does not create a contract.
We may decline or cancel an order, in whole or in part, including where:
- the product is unavailable or out of stock
- there is an error in pricing or product description
- we are unable to obtain payment authorisation
- we suspect fraudulent or abusive activity
- delivery to your address is not possible or lawful
If we cancel an order after payment, we will refund you in full.
Order limits. We may limit quantities per person, household, or order.
5. Pricing and Currency
Prices are shown in the currency of the market you are browsing. The currency and price you see at checkout is the amount charged.
- Prices for some markets are converted automatically and may change with exchange rates.
- Your bank or card issuer may apply its own conversion or foreign transaction fees. These are not charged by us and are not refundable by us.
- Unless expressly stated, prices exclude shipping, taxes, duties, and import charges.
Pricing errors. If a product is listed at an incorrect price, we may cancel the order and refund you in full, even after the order has been confirmed. We are not obliged to supply at the incorrect price.
6. Payment
We accept the payment methods displayed at checkout. By submitting payment details, you confirm that you are authorised to use the payment method.
Payment is processed by third-party payment providers. We do not receive or store your full card details. Your use of a payment method may also be subject to that provider's own terms.
7. Shipping and Delivery
We ship internationally. Estimated delivery times are shown at checkout and are estimates only, not guarantees.
- We are not liable for delays caused by carriers, customs clearance, weather, strikes, or other events outside our reasonable control.
- You are responsible for providing a complete and accurate delivery address. We are not liable for loss resulting from an incorrect address.
- If a parcel is returned to us as undeliverable or unclaimed, we may deduct our actual outbound and return shipping costs from any refund.
Risk and title. Risk of loss passes to you on delivery to the address you provided. Title passes on delivery, or on receipt of full payment, whichever is later. This is subject to any mandatory consumer law in your country that provides otherwise (see Section 18).
8. Customs, Duties, and Import Charges
Orders are shipped internationally and may be subject to customs duties, import taxes, and handling fees imposed by the destination country.
- Where duties and import taxes are calculated and collected at checkout, the amount shown covers the applicable charges, and no further payment should be due on delivery.
- Where duties are not collected at checkout, you are the importer of record and are responsible for all duties, taxes, and clearance fees. These are additional to the purchase price.
- Refusal to pay import charges resulting in return or destruction of the parcel does not entitle you to a full refund. We will refund the product price less our actual shipping and handling costs.
You are responsible for ensuring that the products you order may lawfully be imported into your country.
9. Returns, Refunds, and Cancellation
Our Refund Policy forms part of these Terms and sets out how to return a product and obtain a refund. Please read it before ordering.
Return shipping costs. Where you return a product because you have changed your mind, no longer want it, ordered incorrectly, or for any other reason not attributable to us, you bear the cost of returning the product to us. Return shipping costs are not refunded. We recommend using a tracked service, as you remain responsible for the product until we receive it.
When we bear the cost. We pay the cost of return where the product is faulty, damaged in transit, not as described, or where we sent the wrong item. In those cases, contact us at kontakt@klariva.shop before returning the product and we will arrange or reimburse the return shipping.
This clause does not affect any right you have under mandatory consumer law in your country, including where that law requires us to bear return costs. See Section 18.
Statutory cancellation and withdrawal rights that apply in your country are set out in Section 18 and are not affected by our Refund Policy.
10. Accounts
If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.
We may suspend or terminate an account that breaches these Terms.
11. Intellectual Property
All content on the Site — including text, graphics, logos, images, product photography, page layout, and the "Klariva" name and branding — is owned by us or our licensors and is protected by intellectual property law.
You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written permission.
Products purchased from us are licensed for personal use only. Books and other written materials may not be reproduced, resold, scanned, redistributed, or used to create derivative works.
12. Acceptable Use
You agree not to:
- use the Site for any unlawful purpose or in breach of any applicable law
- attempt to gain unauthorised access to the Site, its servers, or related systems
- introduce malware, viruses, or any harmful code
- scrape, crawl, or harvest data from the Site by automated means without our written permission
- interfere with or disrupt the Site or its security features
- submit false, misleading, or fraudulent information
- resell our products commercially without our written authorisation
We may suspend or terminate your access for any breach.
13. Reviews and Submissions
If you submit a review, comment, photograph, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable licence to use, reproduce, adapt, publish, and display that content in connection with our business, including in advertising.
You confirm that your submission is your own, is accurate, and does not infringe the rights of any third party. We may remove any submission at our discretion.
14. Third-Party Links and Services
The Site may link to third-party websites, tools, or services. We do not control them, do not endorse them, and are not responsible for their content, products, or practices. Your use of a third-party service is governed by that party's own terms.
15. Disclaimers
To the fullest extent permitted by applicable law, and subject always to Section 18:
- the Site and its content are provided "as is" and "as available"
- we make no warranty that the Site will be uninterrupted, timely, secure, or error-free
- we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by applicable law, and subject always to Section 18:
- we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, revenue, data, or goodwill
- our total aggregate liability arising out of or in connection with your order will not exceed the total amount you paid for the products giving rise to the claim
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
17. Indemnification
You agree to indemnify and hold harmless Jayen LLC, its members, officers, and agents from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
18. Country-Specific Provisions
18.1 European Union and European Economic Area (including Germany)
If you are a consumer resident in the EU or EEA, the following applies and prevails over any conflicting provision in these Terms.
Right of withdrawal. You have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party indicated by you, acquires physical possession of the goods. To exercise this right, inform us of your decision by a clear statement sent to kontakt@klariva.shop. You may use the model withdrawal form, but you are not required to.
Effects of withdrawal. We will reimburse all payments received from you, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed of your decision. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is earlier. You must send the goods back without undue delay and in any event within 14 days. You bear the direct cost of returning the goods. You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exceptions. The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery, nor to sealed audio, video, or software media that were unsealed after delivery.
Statutory conformity rights. You benefit from the statutory two-year legal guarantee of conformity for goods. These rights are unaffected by anything in these Terms and are in addition to any commercial guarantee we offer.
Mandatory law. Nothing in these Terms deprives you of the protection of mandatory consumer law of the country in which you reside.
Governing law and jurisdiction. As a consumer, you may bring proceedings in the courts of your country of residence, and the mandatory consumer protection law of that country applies. The arbitration provisions in Section 18.2 do not apply to you.
Online dispute resolution. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
18.2 United States
Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
Binding arbitration and class action waiver. Any dispute arising out of or relating to these Terms or your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Natrona County, Wyoming, or by telephone or video conference at your election, or in your county of residence.
You and we each waive the right to a jury trial and the right to participate in a class, collective, or representative action.
Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
Opt-out. You may opt out of this arbitration agreement by emailing kontakt@klariva.shop with your name, address, and a clear statement that you wish to opt out, within 30 days of your first purchase. Opting out does not affect any other part of these Terms.
California residents. Under California Civil Code Section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by post at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
18.3 United Kingdom
If you are a consumer resident in the UK, the following applies and prevails over any conflicting provision.
Right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from the day you receive the goods to cancel without giving a reason. Inform us at kontakt@klariva.shop. You must return the goods within 14 days of telling us, and you bear the cost of return. We will refund within 14 days of receiving the goods back, including standard delivery cost.
Statutory rights. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. These rights are unaffected by these Terms.
Governing law. English law applies and you may bring proceedings in the courts of England and Wales, or of Scotland or Northern Ireland if you reside there. The arbitration provisions in Section 18.2 do not apply to you.
18.4 Canada
If you are a consumer resident in Canada, the following applies.
Nothing in these Terms limits or excludes any right you have under applicable federal or provincial consumer protection legislation, including the Consumer Protection Act of your province.
Quebec residents. Provisions of these Terms that would be unenforceable under the Consumer Protection Act (Quebec) do not apply to you. The arbitration and class action waiver provisions in Section 18.2 do not apply to Quebec residents. The parties confirm their wish that these Terms be drawn up in English. For consumers, the governing law is that of your province of residence, and you may bring proceedings in the courts of that province.
18.5 Australia
If you are a consumer in Australia, the following applies and prevails over any conflicting provision.
Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in Sections 15, 16, or 17 excludes, restricts, or modifies any guarantee, right, or remedy conferred by the Australian Consumer Law. Where liability may lawfully be limited, our liability is limited to the replacement of the goods, the supply of equivalent goods, the repair of the goods, or the payment of the cost of any of these.
Governing law. The law of your state or territory of residence applies. The arbitration provisions in Section 18.2 do not apply to you.
18.6 New Zealand
If you are a consumer in New Zealand, the following applies.
Our goods come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded. Nothing in these Terms limits your rights under that Act or under the Fair Trading Act 1986.
Where you acquire goods for the purposes of a business, the Consumer Guarantees Act does not apply and the limitations in Sections 15 and 16 apply in full.
Governing law. New Zealand law applies and you may bring proceedings in the New Zealand courts. The arbitration provisions in Section 18.2 do not apply to you.
19. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, epidemic, government action, customs delay, carrier failure, strike, or failure of utilities or telecommunications.
20. Changes to These Terms
We may amend these Terms at any time. The version in force at the time you place your order governs that order. Continued use of the Site after changes are posted constitutes acceptance of the amended Terms.
21. General
Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full effect.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Site and your order.
